- The free brush head/free nozzle (‘Promotion’) commences on 1.07.15 and ends 11:59pm AEDT on 31.03.16 (’Promotional Period’). All claims must be received by 11:59pm AEDT on 14.04.16.
- Offer only applies to the purchase of an ‘Eligible Philips Sonicare Product’ between these dates. Eligible Philips Sonicare Products are (DiamondClean Black (HX9352/04), DiamondClean Pink (HX9362/67), DiamondClean White (HX9332/04), FlexCare Platinum with sanitiser (HX9182/10), FlexCare Platinum without sanitiser (HX9112/02), HealthyWhite (HX6711/02), HealthyWhite+(HX8911/02), GumHealth(HX6631/01), Plaque Defence (HX6231/01), EasyClean (HX6511/50) AirFloss (HX8211/06), AirFloss Pink (HX8221/02), HealthyWhite Twin (HX6782/34), EasyClean Twin (HX6512/02)) (“Eligible Products”).
- Promotion is only open to Australian and New Zealand residents (“Claimant”).
- To be eligible to claim, Claimants must purchase an Eligible Philips Sonicare Product during the Promotional Period.
- Claimants can redeem their free gift being either two brush heads or two nozzles depending upon the product purchased during the Promotional Period by completing the official online form in full (www.philips.com.au/freegift) and ticking the opt in box to receive news and specials from Philips via email.
- Please allow four to six weeks for delivery of the free gift.
- Claimants must retain the original purchase receipt(s) for all claims as proof of purchase. Failure to produce the proof of purchase for a claim when requested may, in the absolute discretion of the Promoter, result in invalidation of the claimand forfeiture of any right to the free gift.
- Multiple claims are not permitted. Only one free gift per purchase of an Eligible Product can be claimed.
- The Promoter reserves the right, at any time, to verify the validity of claims and Claimants (including a Claimant’s identity, age and place of residence) and to disqualify any Claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees provided under the Competition and Consumer Act, as well as any other non-excludable implied warranties under similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
- Except for any liability that cannot be excluded by law, the Promoter, Philips Electronics Australia Limited (ABN 24 008 445 743) (‘Philips’) and Participating stores (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under either the Promoter’s or Philips’ control); (b) any theft, unauthorised access or third party interference; (c) claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a Claimant; or (e) use of the free gift.
- The Promoter collects personal information (“PI”) in order to conduct the Promotion and provide exclusive offers and personalised support to Claimants and may for these purposes, disclose PI to third parties, including but not limited to agents, contractors and service providers and to any Government authorities and agencies. The claim is conditional on providing this PI. All entries become the property of the Promoter.
- Philips Electronics Australia Limited (ABN 24 008 445 743) (‘Philips’) of 65 Epping Road, North Ryde, NSW 2113 collects PI for the purposes noted in clause 12, and may for these purposes, disclose PI to third parties, including but not limited to agents, contractors and service providers and to any Government authorities and agencies. In addition to any use that maybe outlined above or in Philips’ Privacy Policy, if the Participant opts-in by ticking the opt-in box at the time of submitting an Entry Form, Participants consent to the information they submit with their Entry Form being entered into the database of Koninklijke Philips N.V and/or its affiliate companies and this information may be used in any media, for an indefinite period, for future promotional, marketing, publicity, research and profiling purposes including sending electronic messages or telephoning the Participant, without any further reference or payment or other compensation to the Participant. All personal details of the Participant stored by Philips and/or its affiliate companies is subject to Philips Privacy Policy at www.philips.com.au/privacypolicy. A request to access, update or correct any information or to opt out of receiving any communications can be made through Philips’ Privacy Policy website or by clicking on a link on the communication received. Philips may disclose PI overseas, and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. If the PI requested is not provided, the claim may not be processed, and the Claimant will not be able to redeem the free gift. If the tick box is not ticked, Philips will not be able to send exclusive offers and personalised support to Claimant. By participating in this Promotion, Claimants consent to the overseas transfer on these terms and, to the fullest extent permitted by law, agree not to hold Philips liable in this regard.
