1.      To qualify for this offer you must purchase a selected Philips iron, steamer or steam system from participating retailers between 1 March 2012 – and 13 May 2012 (inclusive) to be eligible for one the following tiered rewards;

2.  To claim your chosen reward, purchase your selected Phillips Iron, steamer or steam system from participating stores* and claim online via the process or collect a claim form instore

i. Complete the form and specify your preferred reward (from those specified next to a qualifying purchase) on the Claim Form. All fields on the form must be completed.

ii. Send your completed Claim Form along with your original purchase receipt, a self stamped addressed envelope (SSAE) and cut out of the barcode from the qualifying product’s packaging to Phillips Promotion, PO Box R446, Royal Exchange, NSW, 1225. All four items must be included in order to make a claim. Claims must be received within 14 days of purchase: last claims must be received by close of business 27 May 2012; purchases must be made from 1 March to 13 May 2012 to be eligible. (Note: Your original purchase receipt will be returned for warranty purposes). Eligible participating stores: Target, Big W, Harris Scarfe, Myer, David Jones, Good Guys, Harvey Norman and Retravision and their affiliated online stores. **Cash Back is awarded in the form of an eftpos Gift Card (See further conditions under eftpos Gift Card section).

 

3. Information on how to claim and qualify for the Cash Back (eftpos Gift Card) or Free Movies offer forms part of the Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

 

4. Offer is only open to Australian residents aged 18 years and over (“Claimant”). Employees (and their immediate families) of the Promoter, participating retailers and their employees, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

 

5. This offer is not valid in conjunction with any other promotional or trial offer.

 

6. All successful Claimants who have provided a valid Claim Form, SSAE, original purchase receipt and product barcode will receive their chosen reward by 14th June 2012.

 

7. Incomplete, indecipherable or illegible claims will be deemed invalid. TLC and the Promoter reserve the right, at any time, to verify the validity of claims and Claimants (including a Claimant’s identity, age and place of residence) and to disqualify any Claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions may be accepted at Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

8. If the Claimant opts-in by ticking the opt-in box at the time of submitting their claim, each Claimant consents, to the information they submit with their claim, being entered into a database of Koninklijke Philips Electronics N.V and this information may be used in any media for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the Claimant. All personal details of the Claimant will be stored by Koninklijke Philips Electronics N.V. and are subject to Philips Privacy Policy, see www.philips.com.au/privacypolicy. A request to access, update or correct any information can be made through the Philips Privacy Policy website.

 

9. Any costs incurred by the Claimant associated with claiming the offer including accessing the promotional website, telephone enquiries in relation to the Cash Back (eftpos Gift Card) or Free Movies offer and mailing the Claim Form are the sole responsibility of the Claimant.

 

10. Neither the Promoter nor Philips makes any guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the Claimants’ ability to participate in the promotion.

 

11.   Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

 

12.   Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Claimant; or (f) use of a chosen reward.

Further Conditions: Movie Offer Terms

 

1.      Qualifying Movie Offer recipients can go online only to claim One (1) Movie Voucher per month for the validity of their reward a) 12 months b) 3 months c) 1 month. Customers valid for 1(a) and 1(b) months will receive a physical Movie Pass with a unique code by 14th June 2012, to be input via the promotional website (www.tlcrewards.com/philipsirons) to allow repeat use. Customers valid for 1 month(c) will be posted (via standard post) one (1) Movie Voucher by 14th June 2012, upon receipt of a valid claim. Movie Voucher claims for (a) & (b) will be posted to the claimant (via standard post) following a claim online. Claims made online pre 2.30pm Mon-Fri, will be posted out (from Sydney) on the same business day. Claims made online after 2.30pm or on a weekend will be dispatched on the next business day.

 

2.      Movie Vouchers are valid for use at participating cinemas and are to be exchanged directly for one (1) movie ticket at participating cinemas.

 

3.      For 1(a) and 1 (b) a limit applies of one (1) Movie Voucher claim per month, per customer during the validity of their offer – subject to promotional availability. Last dates to claim the 3 month and 12 month offers are 14/09/12 and 14/06/13 respectively.

 

4.      Only valid recipients who qualify for the Movie Offer will be eligible to claim Movie Vouchers.

 

5.      Subject to the below, Movie Vouchers can be used at participating Event, Greater Union, Birch Carroll & Coyle and Village cinema locations Australia wide. Exclusions include Gold Class and Europa Cinemas, Movie Marathons or any other special screening. A surcharge applies for Vmax theatre entry and 3D presentations. Movie Vouchers are valid for standard movie screenings excluding after 5pm on Saturdays.

 

6.      Movie Vouchers must be presented at a participating cinema and possession of a movie voucher does not guarantee or reserve a seat - seating is subject to availability. Any ancillary costs associated with redeeming the movie voucher are not included and are the responsibility of the bearer.

 

7.      It is the responsibility of the holder to use the Movie Voucher by the specified expiry date. The Movie Voucher has been provided with the understanding that vouchers will not be extended or replaced. Movie Vouchers are valid for a maximum of three (3) months from date of receipt.

 

8.      Movie Voucher(s) cannot be transferred or sold without the prior written consent of participating cinemas.

 

9.      The holder of the Movie Voucher is not entitled to any preferential right over other cinema patrons.

 

10.   Film classification rules apply. ID may be required to obtain Movie Tickets for movies with certain classifications. The use of the Movie Vouchers will be subject to the entry terms and conditions of each participating cinema, including any applicable age restriction as outlined above. This may include the right to eject the redeemer of a Movie Voucher (and any companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst redeeming the Movie Voucher.

 

11.   This Movie Offer is not transferable and cannot be re-sold.

 

12.   Movie Vouchers are non refundable and cannot be exchanged for cash. No change given. Movie vouchers cannot be used in conjunction with any other special or offer where the admission value of the special or offer is greater than the value of standard admission ticket.

 

13.   Neither the Promoter, nor its agents or distributors can accept liability for lost, stolen or damaged Movie Vouchers and reserve the right to withdraw or amend any details and/or offers.

 

14.   Neither Philips, Breville or TLC is liable for any loss suffered by customers when redeeming the Movie Voucher(s).

 

15.   Neither TLC, its agents or distributors, nor the Promoter will in any circumstances be responsible or liable to compensate the purchaser or other bearer, or accept any liability for (a) any non-acceptance by a venue of the Movie Voucher(s) or (b) any inability by the bearer to use the vouchers properly or at all or (c) the contents, accuracy or use of either the vouchers or the venue listing, nor will any of them be liable for any personal loss or injury occurring at the venue, and (d) TLC, its agents and distributors and the Promoter do not guarantee the quality and/or availability of the services offered by the venues and cannot be held liable for any resulting personal loss or damage. Your statutory rights are unaffected.

 

16.   Any disputes between customers pertaining to the use of the Movie Offer/Movie Vouchers are strictly between the customers and the participating cinema.

 

17.   TLC collects claimants’ personal information (from claims requests) in order to conduct this promotion and facilitate the distribution of Movie Passes and Movie Vouchers to claimants. TLC may disclose this information to suppliers and/or their respective agents. Personal information collected for the purposes of this promotion will be used for the purposes of the promotion only. 18.   TLC reserves the right to withdraw or substitute the Movie Offer with one of equal or greater value in the event the Movie Offer is unavailable for any reason.

 

19.   Any persons taking advantage of this promotion do so on complete acceptance of these terms and conditions.

 

20.   The promoter and TLC shall also be bound by these Terms and Conditions and shall not encourage, persuade, promote, support or in any way assist in their breach

Further conditions: eftpos Gift Card (Cash Back)

 

1. Qualifying customers will be sent their eftpos Gift Card and activation details, in two parts (for security reasons) by 14/06/12.

 

2. Depending on your qualifying purchase, you will receive an eftpos Gift card to the value of
a) $100
b) $20
c) $10

 

3. eftpos Gift Card offer recipients can purchase goods/services at retailers in Australia with
eftpos facilities who accept the card, where the eftpos Gift Card has enough unused value to make the purchase.

 

4. eftpos Gift Cards MUST be activated online between 1/07/2012 and 15/07/2012 (activation period) and expire six (6) months after activation. Some merchants may choose not to accept the eftpos Gift Card. Cardholders can check their card balance by visiting www.tlcgiftcards.com/Philipsirons 

 

5.  The eftpos Gift Card cannot be redeemed for cash, reloaded, returned for a refund, have balances of other Gift Cards consolidated to a new eftpos Gift Card,  or be replaced after expiry and is not legal tender, an account card, a credit or debit card or security.


6. If you have a query or complaint about the eftpos Gift Card, please contact 1800 752 130 between Monday to Friday, 9.30 to 5.30 AEST. TLC Marketing is not liable for the availability, quality or fitness for purpose of any goods or services purchased with the eftpos Gift Card. Any dispute about goods or services purchased with the eftpos Gift Card must be resolved with the supplier. To the extent permitted by the law, our liability is limited to replacing faulty eftpos Gift Cards.


7. Please refer any eftpos Gift Card transaction enquiries to TLC. Neither Philips nor TLC is able to reverse any approved transactions.
